Software and Tools License Agreement

Potion Alpha

1. License Grant

Potion Alpha grants you a limited, non-exclusive, non-transferable license to use the provided software and tools (“Tools”) for personal or internal business purposes focused on cryptocurrency trading education.

2. Scope of Use

Tools may include custom-built software by Potion Alpha or third-party software integrated into our service. Each set of tools may come with its own licensing terms which you must also agree to when using those specific tools.

3. Restrictions

You are not allowed to:

  • Reproduce, distribute, sublicense, sell, or commercially exploit the Tools.
  • Modify or create derivative works based on the Tools.
  • Reverse engineer, decompile, or disassemble any part of the Tools, except as permitted by law or by third-party licenses where applicable.

4. Third-Party Tools

Use of our tools might require interaction with third-party platforms like Discord, where additional terms set by those platforms also apply.

5. Ownership

All Tools remain the intellectual property of Potion Alpha or the respective third-party providers. This agreement does not convey any property rights.

6. Termination

Your license to use the Tools will end immediately upon any breach of this agreement or upon termination of your service with Potion Alpha. Upon termination, you must cease all use of the Tools.

7. No Warranty

THE TOOLS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

8. Limitation of Liability

Potion Alpha's liability related to the use of the Tools is limited as set out in the Terms of Service. For third-party tools, liability may also be governed by the third party's terms.

9. Indemnification

You agree to indemnify and hold harmless Potion Alpha, its affiliates, and third-party tool providers from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Tools.

10. Governing Law

This EULA is governed by the laws of Florida, USA, without regard to its conflict of law principles.

11. Updates to the EULA

Potion Alpha may update this EULA to reflect changes in the law, our service offerings, or for other important reasons. Continued use of the Tools after such changes constitutes acceptance of the new terms.
